Nelson Havi seeks court intervention to halt High Court judge selection process

Nelson Havi has requested the court to halt the interview process for the shortlisted judges. Havi contends that Macharia Njeru, the male representative of the Judicial Service Commission (JSC), should not be involved in assessing applications, shortlisting candidates, or conducting interviews for judges.

He asserts that Samson Omwanza Ombati was elected to replace Njeru and is expected to assume office on May 14th.

“The petitioner has suffered and will continue to suffer misrepresentation at the JSC by the second respondent whose elective representative mandate ended with the election of Samson Omwanza Ombati,” reads the petition.

Judicial Service Commission and Macharia Njeru have been listed as respondents in the case. In March of this year, the Judicial Service Commission (JSC) selected 100 candidates for interviews to fill 20 vacancies for High Court judges.

The interviews are scheduled to take place from April 3rd to April 30th, 2024. Havi insists that the JSC should provide an explanation for why the first 20 shortlisted candidates all possess at least 14 years of experience, with none falling below this threshold.

“On the other hand, for the first 20 rejected applications 7 are between 10 years and 14 years practice years limit,” reads court appears.

Havi insists that Njeru’s authority is restricted during the transition period, alleging a conflict of interest. He further alleges that there is discrimination involved in the matter.

“It will be prejudicial and against the public interest to proceed with the interviews set to commence on 3rd April 2024 before a decision is made on serious constitutional issues raised in the petition,” reads court papers.
