Judge overturns acquittal: Nairobi court issues arrest warrants in Rashid Echesa fraud case

A Nairobi court has issued arrest warrants for four businessmen accused alongside former Sports Cabinet Secretary Rashid Echesa in a KES 39 billion fake arms deal fraud case. The individuals, namely Daniel Omondi alias General Juma, Kennedy Mboya, Crispin Odipo, and Clifford Onyango, failed to appear in court during a mention before Milimani Chief Magistrate Susan Shitubi.

Echesa is alleged to have committed fraud by deceiving two foreign nationals through a multi-billion-dollar agreement to provide military equipment at Harambee Annex, the former office of then-Deputy President and current President William Ruto.

Despite Echesa being excused from attending mentions by Trial Magistrate Lucas Onyina, the Senior State Prosecutor requested warrants for the absent individuals. Magistrate Shitubi granted the prosecution’s application, ordering the case to be mentioned on May 13 for further directions.

High Court Judge Kanyi Kimondo overturned the trial court’s decision to acquit Echesa in December 2021, ordering that he now face the defense phase of the trial. Justice Kimondo emphasized that the Office of the Director of Public Prosecutions (ODPP) had presented a compelling case against Echesa, suggesting that the lower court should have found him with a case to answer and proceeded to the defense stage, rather than acquitting him.

As a result, the acquittal on six counts under section 210 of the Criminal Procedure Code (CPC) on December 3, 2021, was reversed and annulled by Justice Kimondo’s ruling. Judge ordered Echesa to appear in person before the Milimani Chief Magistrate on March 4 for mention and directions regarding his defence.
