Why the Sectional Properties Act Is Reshaping Apartment Ownership in Kenya

For years, apartment living has been at the centre of Kenya’s urban housing solution. As cities expanded and land prices rose, vertical development became inevitable. Yet while the physical landscape evolved quickly, the legal framework governing apartment ownership struggled to keep pace. The Sectional Properties Act 2020 represents a decisive shift, one that is reshaping how apartments are owned, financed, and valued in Kenya.

 

Historically, most apartment buyers did not own their units in the true sense of the word. Ownership was often tied to long-term leases or shares in management companies, structures that worked in practice but carried hidden risks. Questions around resale, inheritance, collateralization, and even management rights were common. For many buyers, the legal complexity only became visible when they attempted to sell, borrow against, or transfer their property. The Sectional Properties Act addresses this gap by introducing clear, unit-based ownership. Each apartment is now capable of having its own title, legally distinct yet linked to shared ownership of common areas. This seemingly technical change has far-reaching consequences. It transforms apartments from semi-defined interests into fully recognized property assets.

From an economic perspective, clarity of ownership is foundational as clear titles reduce uncertainty, and reduced uncertainty lowers risk. For banks, this means apartments become more acceptable collateral. For buyers, it means stronger security of tenure. For investors, it improves liquidity, pricing accuracy, and exit options. In effect, the Act enhances confidence across the entire apartment market.

 

The Act also alters incentives within developments themselves. By formalizing management corporations and ownership structures, it encourages better governance of shared spaces and services. Well managed buildings tend to retain value, experience fewer disputes, and attract more stable demand. Over time, this supports healthier neighborhoods and more sustainable urban development.

 

Importantly, the Act aligns Kenya’s apartment market with international property standards. This alignment matters for institutional investors such as pension funds and real estate investment trusts, which require legal certainty before allocating capital. Sectional titles make it easier for such investors to assess risk, structure deals, and participate in residential developments at scale.

 

Implementation has not been without friction. The transition from older lease-based arrangements to sectional titles has caused delays and confusion in some transactions. However, these challenges are characteristic of structural reform rather than evidence of failure. As awareness improves and administrative processes adapt, the benefits of the Act are likely to become more pronounced.

 

Ultimately, the Sectional Properties Act is not just about law, it is about market maturity. By strengthening ownership rights and reducing ambiguity, it is quietly reshaping apartment ownership in Kenya, turning urban housing into a more secure, investable, and transparent asset class.
