EACC asset recovery hits KES 3.8 billion despite fewer traces in 2022/23

The Ethics and Anti-Corruption Commission (EACC) identified public assets worth KES 6.6 billion in the 2022/23 financial year, a decrease from KES 11.2 billion in 2021/22, according to the Kenya National Bureau of Statistics (KNBS).

Despite the decline in asset tracing, the EACC recovered KES 3.8 billion in assets in 2022/23, a significant increase from KES 0.9 billion recovered in 2021/22.

During the 2022/23 review period, the number of investigation reports rose slightly from 1,916 in 2021/22 to 1,968. Reports referred to other public agencies for further action increased from 496 in 2021/22 to 523 in 2022/23.

Additionally, reports pending additional information dropped by 24.7%, reaching 122, while the number of complainants advised on where to report issues rose by 5.6% to 1,745.

In 2022/23, the EACC terminated 894 reports, up from 822 in 2021/22. However, reports forwarded to the Office of the Director of Public Prosecutions (ODPP) decreased to 260 in 2022/23 from 283 in 2021/22.

Of the 260 files sent to the ODPP in 2022/23, 68 were accepted for prosecution, compared to 97 out of 283 the previous year. The number of files recommended for closure and accepted by the ODPP fell from 48 to 18. The ODPP returned 130 files to the EACC for further investigation, with 33 files still awaiting action from the DPP.

The Economic Survey 2024, an annual publication providing socio-economic data over a five-year period, revealed an increase in the number of cases filed in courts, to 424,324 in 2022/23 from 403,182 in 2021/22. Cases disposed of also rose, to 421,549 in 2022/23 from 381,877 in 2021/22.

The survey noted a 2.2% decrease in pending cases, totaling 649,229 in 2022/23. Magistrates’ Courts accounted for 79.4% of these pending cases, while High Courts held 10.4%.
