High Court blocks Obodha’s appointment amid legal dispute

The High Court has issued conservatory orders suspending the appointment of Bruno Oguda Obodha as Managing Director of East Africa Portland Cement Company. The temporary injunction follows a petition filed by Caroline Wambui Mwangi, challenging the legitimacy of the appointment process.

Justice Bahati Mwamuye on January 3, 2025, barred the implementation of a presidential press release dated December 20, 2024, which announced Obodha’s appointment. The ruling also restrains Obodha from assuming office or performing any duties as Managing Director until the court reaches a final determination.

“Mr. Bruno Oguda Obodha, or any other person, is restrained from assuming the office of Managing Director or performing any functions pursuant to the press release dated December 20, 2024,” Justice Mwamuye ruled.

The court further prohibited government agents and any related parties from acting on any documents or instruments related to Obodha’s appointment. “No person, either by themselves or through their agents, shall act upon or give effect to the press release or related instruments appointing Mr. Obodha to the position,” the court added.

The matter is set for mention on February 12, 2025, for compliance updates and further direction.

Wambui’s petition alleges procedural irregularities in the appointment process. The court directed the petitioner to serve all relevant respondents, including Obodha, with the necessary court documents. Respondents have until January 20, 2025, to file their responses, with rejoinders expected by January 27, 2025.
