Role and impact of the Joint Building Council in Kenya’s construction industry

The Joint Building Council (JBC) is a pivotal independent governing body in Kenya, focused on matters related to building construction, engineering, and associated fields.

Established on 24th October 1980 through a collaboration between the Architectural Association of Kenya and the Kenya Association of Building and Civil Engineering Contractors, the JBC aims to elevate standards within the industry. Its primary objectives include providing guidance to its members and promoting sound contractual practices.

To achieve these goals, the JBC has been instrumental in the adoption of equitable forms of contracts, ensuring they are tailored to the specific needs of the Kenyan construction industry. This effort is particularly evident in the JBC form of contract, which was developed to cater to the local market.

Unlike other international contracts such as FIDIC, the JBC form of contract places the Architect as the lead consultant in the project. This localised contract simplifies procedures and timelines for dealing with contractual matters, making it a preferred choice for many developers.

The JBC form of contract is valued for its simplicity and clarity, offering a straightforward approach that ensures all parties involved in a construction project understand their roles and responsibilities.

The contract outlines essential documents such as the letter of award, the agreement and conditions, bills of quantities, specifications, drawings, schedules, and other relevant documents, all of which are integral to the contractual process.

Through these efforts, the JBC plays a crucial role in promoting excellence and suppressing malpractices in Kenya’s construction industry.
