The Office of the Director of Public Prosecutions (ODPP) levied ten charges against Pastor Paul Mackenzie and 94 individuals, responding to a court ultimatum mandating either the filing of charges or the release of the accused.
DPP Renson Mulele Ingonga, in an official statement, asserted that the ODPP possessed ample evidence to substantiate the charges. The accused are alleged to have significantly contributed to the Shakahola Indoctrination Massacre in Kilifi County, resulting in the tragic loss of over 300 lives.
The accusations encompass a spectrum of offenses including murder, manslaughter, radicalization, cruelty, and child torture.
DPP Ingonga has classified these charges according to distinct legal frameworks, including Offenses under the Penal Code Cap 63, Offenses under the Children Act of 2001, the Prevention of Torture Act of 2017, and the Basic Education Act of 2013.
Furthermore, the charges fall within the purview of Offenses outlined in the Prevention of Terrorism Act of 2012 and the Prevention of Organized Crimes Act of 2010.
In light of the ten charges presented, DPP Ingonga instructed that the accused individuals be promptly brought before both the High Court and Subordinate Courts.
On January 9, Senior Principal Magistrate Y.A. Shikanda issued a 14-day ultimatum to the State, compelling them to bring charges against Mackenzie.
