Murang’a court suspends Wa Iria and wife’s charges

Former Murang’a Governor Mwangi Wa Iria and nine co-accused will not face corruption charges at present, as their prosecution is on hold pending a case filed in the Murang’a High Court challenging the legality of their prosecution.

Him and nine other individuals, including his wife Jane Waigwe Kimani and her brother Solomon Mutura Kimani, are accused in a case involving a KES 351 million investigation. Jane and Kimani were arrested on Wednesday and brought before the Milimani Anti-Corruption Court.

Wa Iria’s legal team, comprising Ndegwa Njiru, Wilfred Nyamu, and Peter Wanyama, secured the orders from Justice Cecilia Githua. While the orders were being issued in Murang’a, two of the accused had already appeared before the Milimani law court, awaiting the opportunity to enter their pleas.

Nyamu requested Anti-Corruption Magistrate Thomas Nzyuki to postpone the plea-taking until 3 pm while they obtained the order from Murang’a for presentation at Milimani. Subsequently, the order was provided in court in Nairobi on Wednesday evening.

Nyamu in citing the order said: “This means all accused person’s are protected. We urge this court to down it’s tools and release the two accused person’s unconditionally.”

The Magistrate after perusing the orders from Murang’a said, “Proceedings before this court stand stayed pending the outcome before the Murang’a court.”

Milimani Anti-corruption magistrate Thomas Nzyuki had deferred their plea to 3pm Wednesday before the Murang’a court suspended their prosecution.
