Why DPP Haji Is Unhappy With Sonko’s Acquittal

The Directorate of Public Prosecutions (DPP) Noordin Haji has expressed dissatisfaction over the court’s decision to drop Mike Sonko’s Ksh.20 million graft case.

The DPP said the decision to withdraw the case was based on what the judge termed as a faulty charge sheet, while the same judge took part in the pretrial process that merited the said charge sheet.

Consequently, the DPP said he will appeal the case, which was closed on July 27, 2022, after the prosecution lined up 19 witnesses who provided sufficient evidence to convict Sonko of corruption.

“The ODPP will appeal against the ruling of Hon. Ogoti delivered today acquitting all accused persons in the case of the former governor of Nairobi and others. The court acquitted on the basis that the charge sheet was defective and not on the merits and substance of the case,” said the DPP.

“The prosecution called a total of 19 witnesses and produced 113 documentary exhibits in support of its case and closed its case on 27th July 2022,”

The case was dropped on December 21, 2022, by the Chief Magistrate of the special anti-corruption court in Milimani Douglas Ogoti.

The former Nairobi Governor who expressed gratitude through his social media accounts said there was no sufficient evidence and that the case was politically instigated.

“I have gone through hell for the last 3 years, but I thank God I have just been acquitted by the anti-corruption court chief Hon. Douglas Ogoti for lack of sufficient evidence,” said Sonko.

Sonko was dramatically arrested by a contingent of police officers in Voi in 2019 and bundled into a helicopter before being arraigned.
