The Eldoret High Court has found Jackton Odhiambo guilty of the murder of LGBTQ activist Edwin Kiprotich Kiptoo, commonly known as Chiloba. The conviction follows a compelling case presented by Prosecutor Mark Mugun, who brought forward testimonies from 23 witnesses to establish the details surrounding Chiloba’s brutal death.
In his ruling, Justice Nyakundi confirmed that the prosecution had proven the case beyond a reasonable doubt. He emphasized that the evidence presented, including forensic findings and DNA samples, clearly linked Odhiambo to the crime scene. “I have reviewed all the evidence, including the last-seen theory, forensic and DNA findings, as well as swabs collected, and determined that you were directly linked to the crime scene,” stated Justice Nyakundi.
The court found that Odhiambo had intentionally caused Chiloba’s death, noting that the crime violated Article 26(1) of Kenya’s Constitution, which guarantees the right to life. “The prosecution successfully established all legal elements of murder under Section 203 of the Penal Code,” the judge added.
While the motive behind the murder remains unclear, the court concluded that Odhiambo acted with malice aforethought and harbored deep hatred toward the victim. Despite the lack of a clear motive, the evidence painted a picture of deliberate intent.
