The National Government Constituencies Development Fund (NG-CDF) Board has been granted the green light to proceed with the procurement of a KES 854.7 million software system after the Public Procurement Administrative Review Board (ARB) dismissed a challenge by a losing bidder. This decision clears the way for Agile Business Solutions Ltd, the successful bidder, to supply, install, and maintain an integrated Enterprise Resource Planning (ERP) solution for the NG-CDF Board.
The ARB’s ruling comes after GreenCom Enterprises Solutions Ltd, one of the bidders, filed an application for review, contesting the fairness of the procurement process. GreenCom argued that it had been unfairly disqualified during the evaluation stages of the tender process. However, the ARB found no merit in the complaint, directing the NG-CDF Board to finalize the procurement with Agile Business Solutions Ltd.
“The respondent be and is hereby directed to proceed with the tender No. NG-CDF/RFP/02/2023-2024 request for proposal to undertake supply, installation, implementation, testing, training, commissioning, and maintenance of an integrated NG-CDF Board Enterprise Resource Planning (ERP) Solution to its logical conclusion,” stated the ARB, led by Chairman George Murugu.
The procurement process began with the NG-CDF Board inviting proposals for the ERP software, which will be crucial in managing its operations more efficiently. Five companies submitted bids by the tender deadline in June: Impax Business Solutions Ltd, Attain Enterprise Solutions Ltd, GreenCom Enterprises Solutions Ltd, Kingsway Business Systems Ltd, and Agile Business Solutions Ltd.
Upon evaluation, three of the bidders were disqualified for being non-responsive, leaving only GreenCom and Agile to advance to the final stages. Agile Business Solutions Ltd was ultimately declared the winner after meeting all technical and financial requirements, quoting a fee of Sh854.7 million.
NG-CDF Board’s supply chain manager, Shafee Yaqub Mohamed, recommended the award to Agile, noting that the company successfully navigated all stages of the procurement process. GreenCom’s challenge focused on the marks it received during the technical capacity evaluation, but the ARB found the NG-CDF Board’s decision to be justified.
