The National Authority for the Campaign Against Alcohol and Drug Abuse (NACADA) has issued a stern warning to rehabilitation centers operating in Kenya, emphasizing the need for strict adherence to legal frameworks and data protection guidelines. In a statement released on January 13, 2025, NACADA highlighted concerns over non-compliance, which jeopardizes patient care and exposes individuals to violations of their rights and privacy.
“Failure to adhere to the requisite legal frameworks and data protection guidelines not only jeopardizes the quality of care provided but also exposes clients to potential violations of their rights and privacy,” said Dr. Anthony Omerikwa, MBS, Chief Executive Officer of NACADA.
Under the Narcotic Drugs and Psychotropic Substances (Control) Act, 1994, and the Data Protection Act, 2019, rehabilitation centers are required to meet stringent legal and operational standards. These include compliance with patient confidentiality provisions and maintaining high treatment protocol standards.
Currently, NACADA has accredited only 78 of the 150 rehabilitation centers inspected during the most recent financial year. “Accreditation is granted based on strict adherence to the law and best practices in rehabilitation,” the statement read. Facilities failing to meet these standards have been given a grace period to align with the regulations.
The agency has vowed to take decisive action against centers failing to meet compliance requirements. “NACADA will revoke accreditation for rehabilitation facilities found to violate these regulations and take legal action against non-compliant centers,” Dr. Omerikwa emphasized.
To streamline oversight and public engagement, NACADA has urged stakeholders and the public to seek guidance and report non-compliance through its channels. “The Authority welcomes inquiries and complaints to engage NACADA for guidance,” the statement concluded.
